1. Introduction

Welcome to the HiringFast website.

This website is managed by HiringFast (https://hiringfa.st), (collectively or individually referred to as “HiringFast” or “we/us”). These Terms and Conditions govern your rights and obligations in using or utilizing this site.

2. Definition

In these Terms and Conditions, the following words and expressions shall have the following meanings respectively ascribed to them:

Account: means the personal profile or credentials you create when registering for or using our platform. This includes information such as your username, password, contact details, and any other information associated with your registration and use of the platform.

Personal Data: means any data and information regarding an identified or identifiable information of any individual, either on its own or in combination with other information, whether directly or indirectly, through electronic or non-electronic systems.

Payment Gateway: means an electronic system provided by a Third Party that functions to process online payment transactions, including but not limited to payment authorization, transaction verification, and payment settlement between HiringFast and you, in accordance with the laws in each region.

HiringFast: means sites that provide functions to review CVs or Resume to match with given job description.

Force Majeure: means any event beyond the reasonable control of both HiringFast and you that prevents one or both parties from fulfilling their obligations under these T&C, whether in whole or in part. Such events include natural disasters, fires, floods, earthquakes, pandemics, labor strikes by our employees, war, government actions, failures of telecommunication systems or networks, and other events that cannot be avoided despite reasonable efforts.

Privacy Policy: means an electronic agreement between the user of the Services and us regarding the control and processing of Personal Data, which can be accessed through the following page: Privacy Policy | HiringFast.

Services: means the HiringFast, the official website of HiringFast, all sites owned or produced by HiringFast, and every program organized by HiringFast.

Customer: means individuals, legal entities, or companies that use the HiringFast, whether registered or not.

Third Party: means parties other than us, our affiliates, and subsidiaries who assist us in providing the HiringFast.

T&C: means these Terms and Conditions.

3. Statement

By registering to HiringFast and/or agreeing to the T&C, you acknowledge that you have read, understood, recognized, accepted, and agreed to the T&C, which constitutes an agreement regarding the procedures and terms of use of the HiringFast between you and us.

You agree and acknowledge that we have the full right and authority to amend these T&C from time to time at our sole discretion. Any such amendment will be communicated when you access the HiringFast. These T&C and all its amendments made thereto, constitute the entire agreement between you and us concerning the matters governed herein.

In the event that you do not agree to any part or all of the provisions of the T&C, you must understand that you are not licensed to access or utilize the HiringFast.

4. Platform Terms

  • You acknowledge that users of the HiringFast must be at least 18 years of age or older and must not be under guardianship or conservatorship. Users must have full legal capacity to enter into and agree to this agreement.

  • You shall not use the HiringFast for any purpose that is unlawful, prohibited under these T&C, or deemed unreasonable. You agree that your use of the HiringFast must always comply with applicable laws. As an example, but not limited to, you agree not to use the HiringFast for:

    • Input false data to the HiringFast
    • Reselling, whether in whole or in part, any features within the HiringFast to any other party
    • Interfering with or disrupting the HiringFast, or any servers or networks connected to the HiringFast
    • Violating the security of any network, including attempting to bypass or decrypt passwords or encryption codes, transferring or storing illegal materials, or obtaining passwords, Account, or personal information of other users of HiringFast
    • Transmitting or causing the transmission of:
      • Any material that is defamatory, harms reputation, contains pornography, is vulgar, contains offensive words/sentence, deceptive, misleading, harassing, or may cause discomfort to the other party
      • Malicious content including malware, trojan horses, or viruses that interfere with any user's access to the HiringFast
      • Unsolicited bulk email or other forms of spam, including junk email or chain email
    • Obtaining or attempting to obtain unauthorized access, through any means, to the HiringFast
    • Engaging in any other actions that may cause harm to the HiringFast or negatively impact the operation and continuity of its service
  • If, based on your usage patterns, we suspect that you have engaged in any prohibited activities as outlined in these Terms and Conditions, we reserve the right to disable your user account or temporarily restrict access to certain features available to you.

5. Account Explanation

  • While using HiringFast, you may be required to register and create a user account. By registering an account, you agree to provide and maintain accurate, up-to-date, and complete information at all times throughout the account creation process.

  • For the process and purpose of account creation, we will collect and process your Personal Data, including your name, address, mobile phone number, and electronic mail (email) address, to create and register your account.

  • You are not permitted to assign or transfer your account to any other party under any circumstances.

  • You may register an Account through the platform from the Third Party, such as Google.

  • By registering an account, you will be able to use your account to gain access to HiringFast.

  • If you no longer have control over your account, you are required to immediately notify us (for example, but not limited to), if your account has been hacked in any way, your account is no longer accessible, or your mobile phone has been stolen) so that we can take appropriate action, including blocking and/or temporarily deactivating your account. However, please be aware that you remain responsible for the use of your account and may still be held accountable for any misuse of your account by others.

6. Limitation of Liability

By using the HiringFast, you hereby represent and agree that, to the fullest extent permitted by applicable law:

  • We do not guarantee that:

    • the functions and security features provided in the HiringFast will be uninterrupted or error free;
    • any errors or failures within the HiringFast will be promptly addressed and rectified; and
    • HiringFast will be free from viruses, malware or harmful components.
  • You acknowledge that we shall not be held liable to you or any Third Party for any form of loss, damage, or detriment that may arise, as a result of any action taken or decision made by you or any Third Party on any information, features, or services provided through the HiringFast. This provision shall continue to apply even in the event that you cease using the HiringFast.

  • You acknowledge and understand that HiringFast shall not be held liable for any indirect, consequential, or non-material losses arising from your use of the HiringFast or any claims related to your use of the HiringFast.

The HiringFast contains links to other websites operated by the Third Parties (including but not limited to links that you may use to complete certain transactions).

By clicking on such links, you acknowledge, recognize, and agree that such action is your voluntary decision to view or visit another website. If you choose to access a link directing you to an external site, please be aware that you will be leaving the HiringFast, and any data you provide will be processed in accordance with the privacy policy and cookie policy of the respective Third Party.

Your use of services linked to Third Parties is deemed to be your agreement to all applicable terms and conditions and privacy policies with the relevant Third Party.

By agreeing to this provision, you expressly release us from any and all liability, costs, losses, or damages, whether directly or indirectly caused or alleged to be caused by or in connection with your use of account for the content or resources in question.

8. Computer System Security

  • You are required to maintain and comply at all times with all reasonable security measures to protect your computer system and the data contained therein from unauthorized control, interference or other unauthorized access and comply with all applicable laws, rules and regulations, including, without limitation.

  • You agree to provide Us with evidence of Your compliance with all the provisions in paragraph 1 of this Clause, upon request from Us. Failure to provide such evidence of compliance in accordance with Our wishes may result in suspension of the Services.

  • We provide or suggest best practices to help prevent loss and ensure your best experience using the HiringFast:

    • Adequately whitelist IPs by restricting and controlling access of our Services to trusted users only;
    • Replace API access keys periodically in accordance with industry standards and regulatory requirements;and/or
    • Secure API keys, PINs, passwords or other authentication mechanisms used to log into the Dashboard or transact through the API.

You are solely responsible for reviewing all security controls that we provide or recommend and for determining whether such security controls are adequate or appropriate for their intended purpose. Furthermore, you are responsible for independently implementing any additional security procedures and controls that are not provided by us.

9. Payment

a. Subscription

If you wish to subscribe to available Packages, you may make the subscription payment to us through the designated Payment Gateway. The subscription fee is subject to amendment from time to time at our sole discretion. We shall not be liable for, and you agree to release and hold us harmless (including our directors, officers, employees, and interns) from any claims, losses, damages, or liabilities arising from or related to payment failures when using the Payment Gateway.

In the event that you experience a payment failure through the Payment Gateway, you must immediately contact us through our official contact details as listed. We will escalate your complaint to the Third Party Payment Gateway provider for further resolution. However, any decision made by the Third-Party Payment Gateway provider regarding the payment issue is beyond our responsibility, as such decisions are made solely at the discretion of the Payment Gateway provider. If necessary, we may assist in facilitating communication between you and the Payment Gateway provider.

b. Refund Policy

You may request a refund for the payment of your subscription fee only if there is failed activation for subscription. By agreeing to these terms, you acknowledge and accept that you will not be entitled to request a refund once you have accessed or used any feature. Furthermore, you understand that if your refund request is approved by us, your access paid features will be revoked, and you will no longer be able to use any of the subscription-based services.

To request a refund, you must submit your request through our official contact details as specified in these T&C.

10. Issues

a. Potential Issues

You are required to understand that in using the HiringFast , you may experience various issues, including:

  • disruptions in access or suboptimal site performance;
  • system failures, bugs, or data corruption;
  • inconsistencies or inaccuracies in the displayed information;
  • suspicious activities or misuse of the HiringFast Account by unauthorized parties; and
  • any discrepancy between the features and your expectations due to changes or updates made by HiringFast .

b. Reporting Issues

  • In the event that you experience any issues as referred to in the provision of point a, you may report the details of the problem through the Chat feature, which is accessible through the HiringFast.
  • You are required to report detailed and accurate information regarding the issue encountered, including providing screenshots of your device screen or any other relevant evidence to support the report.
  • You are required to understand that any issues experienced while using the HiringFast are confidential and should only be known between you and us. To the extent permitted by the laws of the Republic of Indonesia, you are prohibited from disclosing, sharing, or distributing any information regarding such issues, including false or misleading information, through social media, forums, or any other platforms without obtaining prior approval from us.

c. Action for the Issues

We are committed to addressing every reported issue. The actions that will be taken include the following:

  • whereas based on the problem report you have submitted, we will carry out an examination of the report at a time frame based on our sole discretion; dan
  • we will provide you with confirmation regarding receipt of the report and provide an estimated completion time.

11. General Terms

a. Personal Data Protection

Information regarding the processing and management of your Personal Data can be accessed and understood through the following page: Privacy Policy.

b. Intellectual Property Right

Unless otherwise stated, all rights contained within the HiringFast , including but not limited to patents, trademarks, copyrights, arrangements, and the infrastructure used to provide the HiringFast services, are owned by or licensed to us. You shall not acquire any rights, title, or interest in any intellectual property associated with the HiringFast , except for the limited license that we grant to you for its use.

You hereby represent and warrant that you will not imitate, reproduce, or otherwise use our trademarks that are within the HiringFast, whether in whole or in part, unless you have obtained prior written permission from us.

Nothing in the provision of the T&C shall be construed as granting you any rights to use our trademarks.

We grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the HiringFast solely for the purpose of utilizing its features and functions for personal and non-commercial use, in accordance with these Terms and Conditions.

Except for the limited license expressly granted above, we do not provide or confer any other rights or licenses in connection with the HiringFast.

c. Indemnification

You hereby agree to fully indemnify, defend, and hold us harmless, including our employees, intern participants, directors, and officers, from and against any and all claims, demands, liabilities, losses, damages, expenses, and reasonable legal fees that may be incurred or asserted by any Third Party or any party other than us as a result of, arising from, or in connection with your actions. This includes, any breach of the T&C, improper use of the HiringFast , infringement of the rights of any Third Party or any party other than us, breaches of our Privacy Policy, and/or any violation of the laws of the Republic of Indonesia.

d. Governing Law

These T&C shall be interpreted and governed under the laws of the Republic of Indonesia.

e. Force Majeure

In the event of a Force Majeure occurrence, we shall not be held liable for any delays, failures, or disruptions in the provision of the HiringFast services that arise as a result of such an event.

We will make our best efforts to restore the affected services within a reasonable period after the Force Majeure event has ended.

You acknowledge that during the period in which the Force Majeure event persists, our obligations to provide and maintain the HiringFast services may be temporarily suspended until the situation returns to normal.

We will provide notifications regarding any Force Majeure event that affects the HiringFast services through our official website or other communication channels that we deem ropriate, including social media platforms and your HiringFast Account.

f. Dispute Resolution

You and HiringFast agree that any disputes, including disputes concerning the validity, existence, performance, and termination of these Terms and Conditions, shall be resolved exclusively through the Sleman District Court.

12. Termination

a. Termination by You

You may terminate these T&C at any time by ceasing to use the HiringFast , which must be done by closing your Account. To close your Account, you must navigate to your HiringFast Account profile, select the "Close Account" option, and complete the process by entering your password confirmation as required,

b. Termination by Us

We reserve the right, at our sole discretion, to terminate or restrict your access to the HiringFast , with or without prior notice, in the event that one or more of the following circumstances occur:

  • your access may be terminated if you breach any provision of these T&C or any other policies that ly to your use of the HiringFast;
  • if you use the HiringFast with the deliberate intent to violate any applicable laws;
  • any activity deemed, at our sole discretion, to be harmful to the HiringFast , our company, other users of HiringFast , and/or any party related to the Third Party;
  • a lawful and valid request from a competent law enforcement agency or government authority in accordance with the provisions of applicable laws; and/or
  • if, due to internal business considerations or policy changes, we determine that discontinuing your access is necessary.

c. Consequences of Termination

  • you must understand that terminating your account through the Close Account option means you will no longer be able to access or use the HiringFast . Additionally, we will delete your data from our system no later than three (3) years from the date of termination.

  • any rights and obligations that have arisen prior to the termination shall remain in effect, including but not limited to any outstanding payment obligations or any compensation that may arise as a result of your use of the HiringFast ; and/or

  • in the event that termination is initiated by us due to a breach committed by you, we shall not be liable for any losses, damages, or consequences that you may incur as a result of such termination.

d. Survived Provision

You must acknowledge and understand that certain provisions shall continue to remain in full force and effect even after the termination, including Intellectual Property Rights, Limitation of Liability, Dispute Resolution, and Governing Law shall remain binding upon you, regardless of the termination of these T&C.

By using the HiringFast , you agree that termination of these T&C shall not release you from any responsibilities or obligations that have arisen prior to the effective date of termination.

13. Severability

If any provision or clause in these Terms & Conditions is deemed invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision or clause in these Terms & Conditions, nor shall it render them invalid or unenforceable under the provisions of any laws of any jurisdiction, court decisions, arbitration rulings, or governmental authorities in any country.

14. Miscellaneous

You are not allowed to transfer all or part of your rights and obligations under the T&C and the Privacy Policy to any party.

However, we may transfer all or part of our rights and obligations under the provisions of these T&C and the Privacy Policy to any party without requiring your prior consent or advance notification.

From time to time, we may provide information related to advertisements, Service improvements, newly launched Services, and other information through email or instant messaging.

We may do so based on the email address and phone number you have registered in the HiringFast system.

You can stop receiving such messages in your email by clicking “Unsubscribe” or contacting us via the official contact details provided in these T&C.

No provisions in these T&C or the Privacy Policy shall be construed as creating a partnership, joint venture, employment relationship, or principal-agent relationship between you and HiringFast.

Our failure to enforce our rights and obligations in the provisions of these T&C cannot be interpreted as an exemption or waiver of those rights and obligations, including our right to enforce them at a later date.
